Personal Data Protection Act (PDPA)

Thailand’s Personal Data Protection Act (PDPA) was adopted into law on May 28, 2019 and has been postponed to commence on 1 June 2022.

WE IP Privacy Policy

WE Intellectual Property Co., Ltd. (WE IP) highly respect your privacy and are aware of the responsibilities in relation to collection, use, and disclosure of your personal data and/or delivery, transfer of your personal data to others.

WE IP greatly values your trust and confidence in us and is committed to processing and protecting your personal data accurately and appropriately. Therefore, it is also very important to us that you understand about methods and procedures for the collecting, use, processing and disclosure of personal data. In this regard, you must read and understand this Policy thoroughly as follows:

WE IP Privacy Policy includes:

1. Personal Data Collection

Types of personal data that WE IP collects, uses, processes or discloses depends on purpose of your consent. In this regard, WE IP aims to collect only personal data necessary or related for contract formation and/or receiving service from WE IP. The personal data that you provide to WE IP (including but not limited to name-surname, identification card number or other identity card number, phone number, date of birth, gender, postal address, email address, financial data) when you engage our services will be collected. Other personal data which consent is required by laws, WE IP will notify you and ask for your consent before collecting data or according to legal period.

When you provide any personal data related to third parties to WE IP, you hereby certify and guarantee an accuracy of such personal data. You also certify and guarantee that you have completely informed those parties of the details of this Policy.

2. Objectives of Collection and Use of Personal Data

WE IP uses the personal data you provide when you use or engage our legal services. The purposes for which your personal data may be used are establishing your identity; communicating with you; managing our relationship with you; providing you with our services; sending you communications which we believe may interest you; to comply with our legal obligations; and when instructing third parties on your behalf (wherever they are located) which may include those third parties providing your Personal Information to government bodies and other entities which administer intellectual property in that jurisdiction; and other service providers including technology and Internet service providers, data storage providers etc.

3. Disclosure and Transfer of Personal Data

WE IP shall keep your personal data confidential. However, in the event that applicable laws allow or the disclosure of such data is necessary to achieve the purpose of processing personal data or other related purposes above, WE IP may provide your personal data to other parties who carry out functions on our behalf or who we instruct on your behalf to provide services to you or as required by law. Where it is necessary for Personal Information to be provided to a third party for the provision of a service to us, we will seek to prevent the unauthorised use or unauthorised disclosure of the Personal Information by the third party. You agree that, subject to any additional obligations under applicable laws, third parties who receive Personal Information from us may use and disclose the Personal Information subject to their privacy policies and the laws applicable to them. WE IP may disclose your personal data in other necessary circumstances, including:

  • Complying with applicable laws.
  • Responding to requests from government agencies or public authorities or otherwise cooperating with authorities pursuant to a legal matter.
  • Responding to matters of personal or public safety.
  • In litigation, investigations, and other legal matters where the personal data is pertinent.
  • Enforcing our terms of services.

We do not disclose Personal Information to third parties for the purpose of third party direct marketing.

4. Consent

You agree that we may share your Personal Information with third parties who carry out functions on our behalf or assist us to deliver our services, such as business associates, contractors, agents or service providers. It is not possible to opt out of receiving communications from us where such communications are required for the conduct of our business (i.e. where you are a client, a former client or a third party with whom we must communicate on a matter for a client).

5. Store and process Personal Information

WE IP may store and process your Personal Information in a country in which WE IP has a business operation i.e. business associates, contractors, agents or service providers. However, WE IP shall formulate standards of agreements and/or business contracts with agencies, organizations that will receive such personal data based on acceptable personal data protection standards and applicable laws in order to ensure security of your personal data. We retain Personal Information for as long as we reasonably require it for legal or business purposes and we take reasonable steps to destroy all Personal Information when we no longer need the Personal Information.

6. Security of Personal Information

WE IP seek to ensure that Personal Information is kept secure and take reasonable steps to protect it from misuse, loss, interference, unauthorised access, modification, or disclosure. We use a variety of security measures both physical and electronic to secure Personal Information.

7. Data Protection Officer and Contact Details

The data protection officer is appointed to investigate operations related to collection, use or disclosure of personal data in accordance with the Personal Data Protection Act B.E. 2562 and the Company’s policies, regulations, announcements, rules, as well as coordinating and cooperating with the Office of the Personal Data Protection Commission.

8. Cookies

Cookies are text files on computers that collect standard internet log information and your website visitor behavior. Cookies are small files that a website or its service provider transfers to your computer’s hard drive through your web browser (if you allow) that enables the website’s or service provider’s systems to recognize your browser and capture and remember certain information as well as your website visitor behavior. While a code in the cookie file enables the site to label you as a particular user, it does not identify you by name, address, or other information unless you have provided the website with such information or set up preferences in your browser to do so automatically. When you visit the Company’s websites, your data will be collected via cookies or similar technologies automatically. You may opt out of accepting cookies by changing the settings on your browser. 9. Amendments to this Policy

WE IP may change this Policy at any time. The current version of this Policy is the version on our website. Changes are effective immediately when we post the new version on our website. Your continued use of our website and/or receipt of our services signify your continued consent to this Policy.
